The Will of George Park of Bingley, Yorkshire

     Dated 29 May 1867 - Proved at Wakefield, 5 December 1868

        This is the last Will and Testament of me George Park of Woodhouse in the parish of Bingley in the County of York Land Agent and Farmer made this twenty-ninth day of May One thousand eight hundred and sixty seven. In the first place I direct my Executors hereinafter named to pay and discharge all my just debt funeral and testamentary expenses and the costs of proving and registering this my Will out of my personal estate. All the residue of my personal estate effects and substance whtsoever and wheresoever, I give and bequeath unto my Executors hereinafter named Upon trust as soon as conveniently may be to convert such part thereof into money as shall not already consist of money or securities for money and thereout I give and bequeath the following pecuniary legacies which I direct shall be paid by my Executors at the expiration of six calendar months from my death namely To the children of my sister Catharine Raw the sum of ten pounds apiece. To the children of my sister Maria Cowling the sum of ten pounds apiece. To the children of my sister Mary Gill the sum of Ten pounds apiece. To my Great Niece Mary Ann Summers[all] the sum of Ten pounds sterling. To my Great Niece Jane Thackeray the sum of Ten pounds sterling. To my Great Niece Hannah the daughter of Thomas Park of Pateley Bridge the sum of One hundred pounds sterling. To my Great Nephew Thomas Iveson the sum of Ten poinds sterling. To the children of Fenton Lawson who died in Cincinnati in America the sum of Ten pounds apiece. To my Great Nephew George Skaife the sum of Ten pounds. To the children of my niece Hannah Bastow the sum of Ten pounds apiece and to my Great Nephew Edwin Scaife the sum of One hundred and fifty pounds sterling. And in case any of the above named legatees shall die before the said legacies shall become payable leaving lawful issue hem or her surviving such issue shall take amongs them share and share alike the legacy which his her or their deceased parent would have taken if living. And as to all the then residue and remainder of my personal estate and effects whatsoever and wheresoever I direct my said Executors forthwith to divide and distribute the same and I hereby give and bequeath the same as follows namely one equal half part thereof unto and amongst the children of my brother Thomas Park deceased including the children of Thomas and Mary the deceased son and daughter of my said brother who are to take amongst them their respective deceased parents shares. The other equal half part thereof I direct shall be divided into two equal parts one sixth whereof I give and bequeath unto and equally amongst the children of my Wifes brother Moses Hey. And one other equal sixth part thereof I give and bequeath to each of the following persons namely my late Wifes Niece Hannah Skaife my late Wifes Niece Ann Craven my late Wifes Niece Mary Wall my late Wifes Nephew Edwin Hey and my late wifes Nephew Aaron Iveson of Keighley in the County of York Draper. And in case of the death of any of the above named residuary legatees before the said residuary legacies shall become payable leaving lawful issue I direct that such issue shall be entitled to and shall receive amongt them share and share alike if more than one the legacy which their hs or her parent would have been entitled to receive if living. I give and devise my two freehold cottages or dwellinghouses with their appurtenances situated at Club Houses in Keighley now or lately occupied by Benjamin Moore and George Sharp unto and to the use of my aforesaid Nephew George Park late of Fell Beck but now residing with me his heirs and assigns for ever. I also give and devise my two freehold cottages with the cellar dwelling under the same with their respective appurtenances situate at Bocking in the parish of Bingley aforesaid now let by me to M Abraham Rhodes unto and to the use of my Great Nephew Edwin Skaife of Woodhouse aforesaid his heirs and assigns for ever. And as to all such estates as are vested in me upon any trust or trusts or by way of mortgage I hereby give devise and bequeath the same unto my said Executors their heirs executors administrators and assigns according to the several natures and qualities thereof Upon trust from time to time to hold convey assign transfer and dispose of the same respectively in such manner and form and as fully and effectively in all respects as I might myself have hled conveyed assigned transferred and disposed thereof if living. And I hereby declare that the receipts in writing of my said trustees or or trustee for the time being shall be an effective discharge for all {monies?} therein expressed to be received by them by virtue of any of the trusts or powers herein contained and shall effectually exonerate the person or persons paying such monies from all resposibility in respect thereof. And I do hereby declare that none of my said Executors shall be responsible for the acts deeds or defaults of the others or other of them nor shall they be accountable for the insuficiency of any Bank, Broker Attorney Solicitor or Agent or any other person or persons whomsoever with whom any of the trust monies may be deposited for safe custody or otherwise or who may receive the same in the course of the execution of the aforesaid trusts nor for the insufficiency of any stocks funds or securities nor for any other loss or damage that may happen or arise of or to any part of the said trust monies and premises unless through the wilful neglect or default of such trustees respectively. And I hereby nominate and appoint the said Aaron Iveson the said George Park now living with me and the said Edwin Skaife of Woodhouse aforesaid Joiner joint Executors of this my Will. And I do hereby revoke and make void all former Wills Codicils testamentary dispositions and appointments whatsoever by me at any time or times heretofore made and declare this to be my last and only Will and Testament. In witness whereof I the said George Park have to this my last and only Will and Testament contained in this and the two preceding sheets of paper set my hand this day and year just above written.

Signed by the within named George Park the testator with a cross and by him published and declared as his last and only Will and Testament in the presence of us who in his presence at his request and in the prsence of each other have hereunto subscribed our names as witnesses

Proved at Wakefield the 5th day of December 1868 by the Oaths of Aaron Iveson (Nephew of Testators late Wife George Park the Nephew and Edwin Skaife (Great-Nephew of the said Testators late Wife in the Will erroneously described as the Great Nephew of the said Testator) the Executors to whom Administration was granted.

The Testator George Park was late of Woodhouse in the parish of Bingley in the County of York Land Agent and Farmer and died on the 14th day of May 1868 at Woodhouse aforesaid.
